I'm pretty sure that he/she would have to be released to the parent/guardian before any further action can be taken; unless the officer believes the child is very likely to re-offend or if it's a class A or B felony (like murder or drugs)
 

The second step in the judicial process for juveniles AFTER being taken into custody is that he/she must have a probable cause hearing. At this stage, a judge will decide if there is enough evidence to support the charges against the youth, and if there is, whether or not to release the youth into parental/guarding custody.
