Personally, yes i believed Chief justice Taney had the authority to comment on the Constitutionality because every judge had the right to give their personal comment on current state of law.
That's being said, Chief Justice Taney was extremely wrong.
He intended to prolong slavery and treat them as property, but it's clearly written in the 5th amendment that "people cannot be deprived of life, liberty, and property"
