Not that it’s ever justified or okay, because it certainly isn’t. But there are instances where the defendant may or may not be given a death sentence.

Age is a common factor in the sentencing of a sexual harassment case- this is because a jury would commonly have a different mindset when it comes to a minor. Personally, I think that should not play a role in a case. Sometimes it does though.

Mental health is another- Sometimes we just have those unstable individuals who need hospitalization rather than jail time.

In order to build a case to which the defendant would be sentenced to death row you would have to elaborate more on the reasoning and motive behind the act.
